WARNING: These Terms and Conditions constitute a legally binding and mandatory agreement between you and PsicoTeddy. Accessing, browsing, and using the website, mobile app, or any related service implies the full, expressed, conscious, and unreserved acceptance of each and every term set forth herein.
1. ACCEPTANCE OF TERMS
By clicking "Accept", registering, accessing, or using any aspect of PsicoTeddy, the user declares that:
They have read these Terms and Conditions in their entirety
They understand and accept them without any reservation
They have the legal authority to be bound by this agreement
They meet all age and eligibility requirements
They agree to be bound by all terms contained herein
If the user does not fully accept these terms, they must not access or use the platform.
2. FUNDAMENTAL WARNING – NOT AN EMERGENCY SERVICE
PsicoTeddy is NOT an emergency service, crisis assistance, rescue, psychiatric intervention, or healthcare service.
PsicoTeddy must never be used as an alternative to professional care in situations of:
Suicidal ideation, planning, or attempt
Self-harm or self-mutilation behaviors
Serious psychiatric disorders
Violence or imminent risk to oneself or others
Severe emotional crisis
Acute traumatic events
Intoxication or substance abuse
In these circumstances, the user must immediately contact the emergency services of their country or an accredited mental health professional.
3. SERVICE DESCRIPTION
PsicoTeddy is an Artificial Intelligence-based digital platform that provides:
Included Services:
Interactive tools for non-clinical emotional support
Informative psychoeducational content
Orientation self-assessments of emotional state
Self-care and wellness resources
Personal tracking of emotional patterns (informative only)
Explicitly NOT Included Services:
Clinical or psychopathological diagnosis
Psychological or psychiatric treatment
Prescription of medications or therapies
Professional mental health consultation
Emergency care
Confidentiality equivalent to a regulated professional relationship
The user explicitly acknowledges that:
There is no doctor-patient, psychologist-client, or therapist-user relationship
The contents are informative and orientative in nature
They do not constitute professional advice of any kind
Their interpretation and use is the exclusive responsibility of the user
4. AGE RESTRICTION AND CONSENT
Access to and use of PsicoTeddy is reserved exclusively for individuals over 13 years of age.
USERS AGED 13 TO 17 (MINORS):
Users under 18 may access PsicoTeddy only with the express authorization of their parent or legal guardian. By accepting these Terms, the minor user declares that:
They have the authorization of their legal representative.
Their legal representative has read and accepted these Terms on their behalf.
Note for residents of Spain: Pursuant to Organic Law 3/2018 (LOPD-GDD), the minimum age of digital consent in Spain is 14. Spanish users aged 13 require verifiable parental consent.
Note for residents of the European Union: Pursuant to Article 8 of the GDPR, in most Member States the age of digital consent is 16. For users aged 13 to 15 residing in the EU, parental authorization is required.
USERS UNDER 13:
Access to PsicoTeddy is absolutely prohibited for individuals under 13.
PsicoTeddy does not knowingly collect personal data from children under 13 (COPPA).
If an account belonging to a child under 13 is detected, it will be permanently deleted without notice.
CONSEQUENCES OF NON-COMPLIANCE:
Immediate and permanent deletion of the account.
Cancellation of access with no right to a refund.
Notification to the competent authorities if applicable.
Parents or guardians who detect use of the platform by minors under their care must report it to: support@psicoteddy.online
5. SELF-ASSESSMENTS, RESULTS AND INTERPRETATION
The self-assessment tools offered by PsicoTeddy generate referential, statistical, and purely orientative results.
The user acknowledges and agrees that:
The results DO NOT constitute clinical, psychological, or psychopathological diagnosis
They should not be interpreted as medical or professional conclusions
They are only orientative indicators based on statistical algorithms
They may contain errors, inaccuracies, or technical limitations
They cannot be used as a basis for medical or treatment decisions
The user is solely responsible for:
Interpreting the results correctly
Seeking professional consultation when appropriate
Not relying exclusively on the results for health decisions
Validating any information with accredited professionals
6. AUTOMATED RISK DETECTION SYSTEM
PsicoTeddy incorporates automated content analysis systems to detect potential signs of serious risk.
Scope and Limitations:
The system is preventive and orientative in nature
It does not have diagnostic capacity
It may contain false positives or false negatives
It does not substitute professional evaluation
It is not a guarantee that all risks will be detected
When risk detection is activated, the platform may:
Limit or suspend regular functions
Display safety warnings and messages
Enable direct contact buttons with emergency services
Show telephone numbers and official helplines corresponding to the country
Provide web addresses of crisis resources
Requires direct user action to contact external services
Responsibilities:
The platform does NOT automatically contact emergency services on behalf of the user
The responsibility to seek help lies exclusively with the user
PsicoTeddy does not guarantee response or effectiveness of external services
The user understands that emergency services act independently
7. USER ACCOUNTS AND SECURITY
Creation and Registration:
The user is responsible for providing accurate and complete information
The user guarantees that the data provided is truthful
The user is responsible for maintaining the confidentiality of their credentials
The user will immediately notify of unauthorized accesses
User Responsibilities:
Maintain confidentiality of username and password
Use secure and complex passwords
Do not share credentials with third parties
Assume responsibility for all activity conducted from their account
Log out after each use on shared devices
PsicoTeddy Rights:
Suspend or cancel accounts that violate terms
Access account information if required by law
Monitor activity to detect fraud or abuse
8. PERMITTED AND PROHIBITED USES
Permitted Uses:
Personal, private, and non-commercial use of the service
Access to informative psychoeducational content
Emotional self-expression through interactions with AI
Personal wellness tracking (internal use)
Explicitly Prohibited Uses:
Access by minors
Use for commercial, lucrative, or advertising purposes
Attempts to breach security, codes, or encryption
Reverse engineering, decompilation, or code analysis
Mass data extraction or scraping
Use of bots, scrapers, or unauthorized automated tools
Distribution of malware, viruses, or malicious code
Harassment, abuse, threats, or illicit conduct
Violation of third-party rights
Distribution of illegal, obscene, or discriminatory content
Spam, phishing, or fraud
Non-compliance with local or international laws
Consequences:
Immediate termination of access
Withholding or confiscation of funds if applicable
Referral to competent authorities
Civil and criminal prosecution according to law
9. INTELLECTUAL PROPERTY RIGHTS

Software and source code
Interfaces and designs
Original contents
Databases
AI algorithms
Registered trademarks and logos
Any original creation
License of Use:
The user receives a limited, personal, revocable, and non-transferable license to use the platform only in accordance with these terms.
Prohibitions:
No ownership right of any element is granted
You may not reproduce, copy, modify, or distribute
You may not create derivative works
You may not use for commercial purposes
You may not decompile or analyze code
You may not transfer the license to third parties
10. LIMITATION OF LIABILITY
COMPLETE DISCLAIMER OF LIABILITY:
PsicoTeddy shall NOT be liable for:
Direct, indirect, incidental, consequential, or punitive damages
Economic, data, reputation, or opportunity losses
Interruptions, suspensions, or service failures
Technical errors, bugs, or vulnerabilities
Unauthorized access or security incidents
Third-party content, external links, or references
Misuse of the platform by third parties
Incorrect interpretations of assessments
User decisions based on platform content
Actions or omissions of external emergency services
Any other damage that is not preventable by reasonable conduct
Maximum Liability Limit:
In no event shall the total liability of PsicoTeddy exceed the amount paid by the user in the last 12 months, or zero if no payments have been made.
11. WARRANTIES AND DISCLAIMER
Disclaimer of Warranties:
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND.
PsicoTeddy explicitly disclaims:
Merchantability warranty
Fitness for a particular purpose warranty
Non-infringement warranty
Warranty of accuracy, completeness, or timeliness of contents
Continuous availability warranty
Warranty of absence of errors or bugs
Absolute security warranty
Any other implicit or explicit warranty
The user agrees that:
The service may contain errors
Some content may not be accurate
Availability is not guaranteed
Security has inherent technical limitations
12. SERVICE AND TERMS MODIFICATIONS

PsicoTeddy reserves the right to:
Modify, suspend, or discontinue services
Change prices, plans, or features
Security updates or technical improvements
Changes in content or assessments
Terms Modifications:
PsicoTeddy may modify these Terms at any time:
Notice will be given through a notice within the platform
Continued use implies acceptance of changes
If the user does not accept, they must stop using the platform
13. SUSPENSION AND TERMINATION OF ACCESS
Causes for Suspension:
Breach of these Terms
Fraudulent or unauthorized use
Illicit conduct
Security risk
Violation of third-party rights
Non-payment (if applicable)
Procedure:
PsicoTeddy may suspend immediately without prior notice
The user will be notified of the reason when possible
The user may request a review of the decision
Termination:
The user may terminate at any time
Some obligations persist after termination
Data will be treated according to the Privacy Policy
14. ARTIFICIAL INTELLIGENCE LIMITATIONS
PsicoTeddy uses generative Artificial Intelligence technology (a large language model). The user acknowledges and accepts that:
a) Technical limitations: AI systems may generate inaccurate, incomplete, or incorrect responses, a phenomenon known as "hallucination". PsicoTeddy does NOT guarantee the accuracy of any generated response.
b) Explicit system prohibitions: PsicoTeddy is configured to NEVER:
Issue clinical diagnoses of any kind.
Recommend medications, drugs, or dosages.
Apply clinical therapeutic protocols.
Claim that anything "cures" or "treats" mental health conditions.
c) User responsibility: The user is solely responsible for the decisions they make based on the AI's responses. No PsicoTeddy response should be interpreted as medical, psychological, or professional advice.
d) Health decisions: For any decision related to their mental or physical health, the user MUST consult a duly licensed mental health professional.
15. SUBSCRIPTIONS, PAYMENTS AND REFUNDS
Subscription plans: PsicoTeddy offers a free plan with limited features and a Premium plan with full access, managed through RevenueCat and integrated with the Apple App Store and Google Play.
Billing: Subscriptions are billed periodically (monthly or annually) according to the selected plan. Charges are processed through the corresponding app store.
Cancellation: The user may cancel their subscription at any time from their account settings in the Apple App Store or Google Play. Cancellation takes effect at the end of the current billing period.
Restoring purchases: Users may restore previous purchases from the "Subscription" section of the app profile.
Refunds: Refund requests are handled according to the refund policy of the Apple App Store or Google Play as applicable. PsicoTeddy does not process refunds directly.
16. GENERAL PROVISIONS
Applicable Law:
These Terms are governed by the laws of the Republic of Peru.
Jurisdiction:
Any dispute will be resolved in accordance with Peruvian laws, without prejudice to the user's right to go to the authorities of their country.
Severability:
If any clause is invalid, it will be considered separable without affecting the rest.
Validity:
The Terms enter into force immediately and remain in force as long as the user accesses the platform.
